Welcome to RealtoGen. These Terms of Service ("Terms") govern your access to and use of the RealtoGen website, platform, and services (collectively, the "Service") provided by RealtoGen ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1) Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2) Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

  1. Provide accurate, current, and complete information during registration
  2. Maintain and promptly update your account information
  3. Keep your account credentials confidential and secure
  4. Notify us immediately of any unauthorized use of your account
  5. Accept responsibility for all activities that occur under your account

3) Service Description

RealtoGen provides an AI-powered platform that generates drone-style aerial videos from property addresses and imagery. The Service uses artificial intelligence and machine learning technology to create video content.

Important Limitations:

  • AI-generated content may contain inaccuracies or hallucinations
  • Output quality depends on input data availability and quality
  • The Service is provided "as is" and we make no guarantees about specific results
  • Generated content is for marketing and visualization purposes only

4) Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Create, upload, or distribute prohibited content as defined in our AI Safety & Responsible Use Policy
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to create deceptive, fraudulent, or misleading content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) without express written permission
  • Resell, redistribute, or commercialize the Service without authorization

5) Intellectual Property Rights

A) Our Rights

The Service, including its software, features, content, and trademarks, is owned by RealtoGen and protected by intellectual property laws. These Terms do not grant you any ownership rights to the Service.

B) Your Content

You retain ownership of any content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store Your Content solely to provide and improve the Service.

C) Generated Output

Subject to your compliance with these Terms and our policies, you own the output generated by the Service based on Your Content, except that we retain rights to use anonymized, aggregated data for service improvement.

6) Payment and Subscriptions

Certain features of the Service require payment. By purchasing a subscription or credits, you agree to pay all applicable fees.

  1. All payments are processed by our payment processor, Dodo Payments
  2. Fees are non-refundable except as specified in our Refund Policy
  3. Subscriptions automatically renew unless cancelled
  4. We reserve the right to modify pricing with advance notice
  5. You are responsible for all taxes associated with your purchase

Compute Consumption & Credit Delivery

Users are purchasing AI render credits, which are delivered instantly to the user's account balance upon successful payment. Once a user inputs a property address and initiates a generation, credits are irrevocably consumed to reserve server capacity and trigger the GPU rendering process. Due to the high compute costs and infrastructure required for 3D environment generation (averaging 2–6 hours per job), all consumed credits are strictly non-refundable.

7) Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion.

You may terminate your account at any time by contacting us. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete Your Content and generated outputs
  • No refunds will be provided except as stated in our Refund Policy
  • Certain provisions of these Terms will survive termination

8) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of generated content

WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PURPOSES. YOU USE THE SERVICE AT YOUR OWN RISK.

9) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALTOGEN SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from AI-generated content inaccuracies or errors
  • Any damages exceeding the amount you paid us in the 12 months before the claim

10) Indemnification

You agree to indemnify, defend, and hold harmless RealtoGen and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  1. Your use of the Service
  2. Your violation of these Terms
  3. Your violation of any rights of another party
  4. Your Content or generated outputs

11) Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Ankara, Turkey, except that either party may seek injunctive relief in court for intellectual property matters.

12) Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  1. Posting the updated Terms on our website
  2. Updating the "Last Updated" date
  3. Sending email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13) General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and AI Safety Policy, constitute the entire agreement between you and RealtoGen.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
